RJA succeeds in jury trial involving an off-duty officer with the Worcester Police Department

In 2011, a member of the Worcester Police Department was sued by a husband and wife for assault and battery, the intentional infliction of emotional distress and harm to their marital relationship based upon an incident that occurred while the officer was off-duty.  On October 31, 2012, the case was tried to a jury in Fitchburg District Court.  During the trial, it was argued to the jury that the husband and wife were exaggerating their claims significantly in an attempt to obtain an award of money.  After a half hour of deliberations, the jury returned a verdict that rejected all of the wife’s claims against RJA’s client and also awarded the husband no damages based upon his claims.

RESULT:  A favorable jury verdict in favor of RJA’s client.

RJA Counsel:  Andrew J. Gambaccini
